Police: Two 12-Year-Old Boys Arrested For Sexual Abuse Charges In Westhampton Beach

A Westhampton Beach Village Police investigation led to the arrest of two 12-year-old boys on felony sexual abuse charges. The arrests on May 30 and 31 were linked to the same event and involved one victim, who is a minor, according to Detective Brian Prescott.

An investigation was initiated at the police department when a relative of the victim reported the incident, Det. Prescott said. Because the case involves minors, police would not identify anyone involved nor provide any further details of the incident or investigation, he added.

The two boys were arrested for sexual abuse in the first degree, a Class D felony, police said. They were issued appearance tickets for an intake conference on June 13 as part of charges filed in the juvenile justice system. They were then released, one of them into the custody of his mother and attorney, and the other into the custody of his legal guardian and attorney.

According to New York Penal Code, a charge of first degree sexual abuse involves sexual contact with another individual without the latter’s consent. It can mean the victim is less than 11 years of age, that force was used or that the victim is “physically helpless.”
